Terms of Enrollment
Applicant Right to Cancel: Applicant may cancel a class 45 days before the course for the registration amount minus a $35.00 enrollment fee. Cancellations with less than 45 days notice are non-refundable but we will permit the applicant to transfer to another class held within one (1) year of the date of the original class. ERTI is, for business reasons, prevented from granting refunds or transfers with cancellation of 45 days or less. ERTI will accept another qualified applicant substituting in the original applicant's place at any time prior to the beginning of class instruction.
ERTI Right to Cancel: ERTI retains the right to cancel a class at any time due to circumstances beyond its control. Please keep this in mind when making additional commitments related to the class such as airplane, hotel, and car reservations--as ERTI is not responsible for reimbursement of any such charges. In the event of cancellation, ERTI will use its best efforts to give prompt notice.
Release of Liability: Prior to the beginning of instruction all applicants will be required to sign a Release of Liability and Notice of Assumption of Risk.

Voluntary Release of Liability and Notice of Assumption of Risk
The Client has requested that the Emergency Response Training Institute (ERTI) provide Client with training services ("Training") with respect to actions that may be taken in the event of certain emergencies ("Emergency"). In consideration of the foregoing, and to induce ERTI to provide Client with such Training, Client hereby agrees as follows:
Nature of Training: Client understands that any fire, earthquake, flood, or similar event is an extremely hazardous situation and that there is INHERENT DANGER in being involved in any manner in an Emergency or Training. In particular, an Emergency may involve numerous conditions and circumstances which cannot be anticipated at the time of the training. Client further understands that such Training is merely intended to suggest practical ways to respond to an Emergency. Client acknowledges that such Training will not address all eventualities or circumstances involved in such Emergency.
No Representations and Warranties: Client acknowledges and agrees that ERTI has not made, and is not making, any representations, warranties, or guarantees, with respect to Training provided to Client, and Client hereby waives all remedies, warranties, guarantees or liabilities, expressed or implied, with respect to the Training provided to Client, arising by law or otherwise.
Release, Discharge and Covenant Not to Sue: Client, on behalf of himself or herself and his or her heirs, executors, administrators or assigns, hereby releases ERTI, its officers, agents, employees, and any other owner or provider of facilities at which or with which such Training is conducted (collectively "Releasees") from any and all claims and liability arising out of the acts or omissions, including without limitation the ordinary negligence of Releasees which causes any injury, death, damages or property damage to Client wherever or however the same may occur and Client hereby covenants not to sue Releasees on any such claim. Client hereby covenants to hold Releasees harmless and indemnify Releasees for any claim, judgment or expense arising out of any Emergency involving Client.
Assumption of Risk: Client fully and voluntarily assumes all risks in connection with the Training, the use of the Training, or any Emergency.
THE CLIENT HAS READ THIS DOCUMENT AND UNDERSTANDS THAT IT IS A RELEASE OF ALL CLAIMS. THE CLIENT ASSUMES ALL RISKS INHERENT IN AN EMERGENCY RESPONSE AND IN ERTI EMERGENCY RESPONSE TRAINING AND WSHA WASHINGTON STATE HOSPITAL ASSOCIATION. THE CLIENT HAS EXECUTED THIS RELEASE VOLUNTARILY, EVIDENCING ACCEPTANCE OF THE ABOVE PROVISIONS IN CONSIDERATION OF BEING ADMITTED TO AN ERTI CLASS.
